By downloading, installing, or using the BenchRep application ("the Application"), you agree to be bound by these terms of service ("Terms"). If you do not accept these Terms, please do not use the Application.

2. Service Description

BenchRep is a mobile strength training tracking application that allows users to:

Track their workout sessions
Create and manage custom exercise programs
View progress statistics
Access an exercise catalog
Record their personal records

3. AI Coach

The Application offers an AI (Artificial Intelligence) coach accessible via an interactive chat to support users in their fitness journey.

3.1 Availability

The AI coach is available for free to all users, with usage limits. Premium users benefit from higher usage limits.

3.2 Service Interruptions

The AI coach service may be temporarily disabled or unavailable for maintenance, technical updates, or any other reason at our discretion. We do not guarantee permanent availability of this feature.

3.3 Access Restrictions

We reserve the right to restrict or suspend your access to the AI coach in case of:

Abusive or excessive use of the service
Inappropriate, offensive, or improper behavior
Attempts to circumvent usage limits
Violation of these terms of service
Any other reason at our discretion

3.4 Disclaimer

Advice provided by the AI coach is automatically generated and does not replace the advice of a healthcare professional or qualified sports coach. Use this information at your own risk.

4. User Account

To use certain features of the Application, you must create an account. You are responsible for:

The confidentiality of your login credentials
All activities performed through your account
Providing accurate and up-to-date information
Notifying us immediately of any unauthorized use of your account

4.1 Account Deletion

You may request deletion of your account at any time through the Application settings. Please note that:

After requesting deletion, your data will be retained for a 30-day period during which you can restore your account
After this 30-day period, your personal data will be permanently anonymized
Once your data is anonymized, account restoration will no longer be possible
This action is irreversible after the 30-day grace period expires

5. Subscriptions and Payments

5.1 Subscription Plans

BenchRep offers:

- Free: limited access with ads

- Premium: full access without ads + increased AI usage limits

- Premium AI+ (if available): same benefits as Premium + even higher AI usage limits

Paid subscriptions may be available monthly and/or yearly. The exact price (and currency) is shown at the time of purchase in the App Store (iOS) or Google Play (Android) and may vary by country.

5.2 Payment and Auto-Renewal

Payment will be charged to your Apple ID account (iOS) or Google account (Android) at confirmation of purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Renewal will be charged within 24 hours prior to the end of the current period at the then-current rate.

5.3 Managing, Cancellation, and End of Subscription

You can manage or cancel your subscription at any time from:

- iOS: Settings > [your name] > Subscriptions

- Android: Google Play > Payments & subscriptions > Subscriptions

Cancellation takes effect at the end of the current billing period. Any unused portion of the current period is not refunded, except where required by the platform’s policies or applicable law.

5.4 Free Trial (if applicable)

If a free trial is offered, it will automatically convert to a paid subscription unless canceled at least 24 hours before the end of the trial. If you purchase a subscription during a free trial, any unused portion of the trial may be forfeited.

5.5 Refunds

Refund requests are handled exclusively by the App Store or Google Play, subject to their rules and policies.

5.6 Restore Purchases

If available in the Application, you may restore purchases (e.g., “Restore Purchases”) to recover your subscription on a new device using the same Apple/Google account.

6. Acceptable Use

You agree not to:

Use the Application illegally or fraudulently
Attempt unauthorized access to systems or data
Disrupt or interfere with the Application's operation
Copy, modify, or distribute the Application's content without permission
Use the Application to transmit offensive or inappropriate content

7. Intellectual Property

The Application and all its content (texts, images, logos, source code) are the property of BenchRep and are protected by intellectual property laws. You receive a limited, non-exclusive, and revocable license to use the Application in accordance with these Terms.

8. Medical Disclaimer

IMPORTANT: The Application is intended for informational and tracking purposes only. It does not replace professional medical advice. Before starting any exercise program, consult a healthcare professional. BenchRep is not responsible for injuries or health problems resulting from the use of the Application.

9. Limitation of Liability

To the fullest extent permitted by law, BenchRep shall not be liable for direct, indirect, incidental, special, or consequential damages resulting from:

Use or inability to use the Application
Data loss
Physical injuries or health problems
Unauthorized access to your data

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted in the Application and take effect immediately. Your continued use of the Application after the posting of changes constitutes your acceptance of the new Terms.

11. Termination

We may suspend or terminate your access to the Application at any time, with or without notice, for violation of these Terms or for any other reason. You may also stop using the Application at any time.

12. Governing Law

These Terms are governed by French law. Any dispute will be subject to the exclusive jurisdiction of French courts.
